On Spetmber 14, 2021 the Northern District Court of New York granted a temporary restraining order (TRO) to stop the state from overriding federal law. U.S. Federal District Judge David N. Hurd issued a TRO to bar the state from requiring employers to deny religious accommodations and from forcing all health care workers to comply with the state’s unconstitutional COVID-19 vaccine mandate (NY Vaccine Mandate).
The TRO was issued in connection with an ongoing lawsuit filed against NY Governor Kathy Hochul, Department of Health Commissioner Dr. Howard A. Zucker and Attorney General Letitia James by the Thomas More Society on behalf of plaintiff health care workers, including nurses, doctors, and technicians.
The federal court has confirmed the legal course advocated by PJI to preserve your religious liberty rights – health care workers can and should assert their rights to protect their religious liberty under Title VII of the Civil Rights Act of 1964 (Title VII). The state cannot strip health care employees of their federally protected rights.
